    Bill Summary

    ON MARCH 9, 2020, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2363, AS AMENDED.

    AMENDMENT #1 rewrites this bill and revises various provisions governing elections, as follows:

    (1) This amendment deletes the following requirements of present law (a violation of which are Class A misdemeanors under present law):
    (A) The requirement that a public communication regarding voter registration status made by a political committee or organization display a disclaimer that such communication is not made in conjunction with or authorized by the secretary of state;
    (B) The requirements that: a person or organization that establishes a website for voter registration purposes display on such website a disclaimer that the voter registration is not made in conjunction with or authorized by the secretary of state; and a person or organization that establishes a voter registration website and captures or collects the voter's information or data disclose on the website the person's or organization's name and the purpose for which the voter information is captured or collected; and
    (C) The requirements that: a person or organization that establishes a voter lookup website display on such website a disclaimer that the voter lookup is not made in conjunction with or authorized by the secretary of state; and a person or organization that establishes a voter lookup website and captures or collects the voter's information or data disclose on the website the person's or organization's name and the purpose for which the voter information is captured or collected;
    (2) This amendment deletes the provision whereby a civil penalty may be imposed on a person for submission of incomplete voter registration applications. The present law provision applies to a person or organization that conducts voter registration drives and, within a calendar year, files 100 or more incomplete voter registration applications with one or more county election commissions;
    (3) This amendment deletes the present law provisions that imposes certain conditions on a person or organization who has not been designated by the county election commission and who conducts a supplemental voter registration drive in which the person or organization attempts to collect voter registration applications of 100 or more people. This amendment retains the prohibitions on a person or organization employing or compensating any person, or receiving wages or compensation for registering voters based on the number of voters registered; and on a person or organization establishing quotas or a minimum number of completed voter registration forms to be collected by individuals conducting a voter registration drive; and
    (4) This amendment adds the following new provisions governing "voter registration drives" and defines that term as collecting voter registration applications from another person and submitting the collected application to the county or state election commission for the purposes of registering that person to vote (the term does not include state or county governmental entities operating in the course and scope of their official duties):
    (A) The coordinator of elections must offer free voluntary training to individuals or organizations who conduct voter registration drives. The training must, at a minimum, summarize the laws and procedures regarding voter registration. A list of those individuals or organizations who complete the training may be published on the secretary of state's website or published by any other means deemed appropriate by the secretary of state;
    (B) Any person or organization collecting a voter registration form submitted by an applicant during a voter registration drive must, within 15 calendar days of receipt of the form, deliver or mail the form to the county election commission in which the applicant resides according to the address on the application or to the state election commission; provided, that if the date of the receipt of the form is within 15 calendar days of the voter registration deadline, the submitted forms must be delivered or mailed no later than the voter registration deadline;
    (C) Any person or organization other than a federal, state, or county governmental entity operating in the course and scope of its official duties who conducts a voter registration drive or operates an online voter registration platform is prohibited from copying, photographing, or in any way retaining, electronically or physically, personal identifying information collected on a voter registration application or entered into the online voter registration platform, including name, date and place of birth, residential address, mailing address, email, phone number, and signature for any purpose other than voter participation, voter engagement, or voter turnout unless the person or organization informs the applicant how the applicant's personal information will be used by the person or organization and the applicant expressly consents in writing or electronically. The social security number provided on the voter registration application or entered into the online voter registration platform will be confidential and must not be copied, photographed, or in any way retained, electronically or physically, by any person other than election officials in their official capacity;
    (D) The state election commission may impose a maximum civil penalty up to $50.00 for each violation of the present law prohibitions described above in (3) and the provisions of this amendment described above in (A)-(C). This amendment sets out in detail the requirements for an assessment letter sent by the election commission, the response that is required, and the process to request a waiver or reduction of a penalty; and
    (E) A person or organization that provides or publishes erroneous or incorrect information regarding the qualifications to vote, the requirements to register to vote, whether an individual voter is currently registered to vote or eligible to register to vote, voter registration deadlines, or polling dates, times, and locations must, upon discovery, immediately notify the appropriate county election commission and the coordinator of elections; and
    (5) This amendment adds "the cyber security practices in place to protect the integrity of the voter registration process" to the items that the coordinator of elections and the state election commission must consider in determining whether a voter registration system may be certified.
