The fight for temporary hazard pay

United Public Workers is at the forefront of significant legal battles in seven jurisdictions concerning Temporary Hazard Pay which had been guaranteed to workers under collective bargaining agreements prior to the pandemic

As your State Director, you know I’ve got your back. I’m proud to be your advocate in matters with the Employer. Over the past months, I’ve had the pleasure of speaking directly with many of you at meetings. The conversations frequently go back to Temporary Hazard Pay (THP) and our fight with the Employer. As these cases progress, I’ll post regular updates on this page. I also discuss it in our latest episode of the United 808 Podcast, which you can watch here.

United Public Workers is at the forefront of significant legal battles in seven jurisdictions concerning THP, which had been guaranteed to workers under our collective bargaining agreements prior to the pandemic. The pandemic emergency led to Governor David Ige’s suspension of HRS 89, challenging our collective bargaining rights. Yet, we stand united, demanding the employer acknowledge the risks our workers faced and honor their agreement. This collective effort is critical to securing fair compensation for our essential workers who faced heightened risks and protecting their rights.

Our tireless fight for a fair settlement is bearing fruit. We have already succeeded in Maui County and the Judiciary. In other jurisdictions, our legal team, along with courageous union member witnesses, is preparing for arbitration. The City and County of Honolulu arbitration has finished, and a decision is expected in July barring any unforeseen continuances. Hawaii County’s arbitration is set to begin in May, with the University of Hawaii’s scheduled for July. In the remaining jurisdictions, we are progressing with our case as the Employer remains responsive. This progress is a testament to our collective strength and determination.

In April, we filed a complaint against the Department of Human Resources Development regarding temporary hazard pay for the Executive Branch. Despite our repeated efforts, the employer has ignored our requests to proceed with the grievance procedure after failing to award THP to these employees. We ask the Hawaii Labor Relations Board to order the employer to comply with their contractual obligations. We believe the employer has violated employees’ rights and are seeking an order to prevent further violations.

I ask you to stay vigilant and informed. Share this update with your coworkers and celebrate the victories of your brothers and sisters in this union and others. When an injury to one is an injury to all, so too is a victory for one, a victory for all.
